Terms of service

Last updated: 7 November 2026

These terms are a contract between you (the business using Fyno) and us. Please read them carefully. By creating an account or using Fyno, you agree to them. If you are accepting on behalf of a business, you confirm you have authority to do so.

1. Who we are

Fyno is a trading name of Simon Webb, a sole trader based in the United Kingdom ("Fyno", "we", "us"). Address: [Business address]. Email: support@fynopayments.co.uk.

We may transfer these terms to a limited company we set up to run Fyno (for example, Fyno Ltd). If we do, we'll tell you, and your rights under these terms won't be reduced.

2. What Fyno is, and what it isn't

Fyno is software. It lets businesses create payment requests, send payment links by SMS, WhatsApp, email or QR code, set up deposit and stage-payment plans, send reminders, track payment status, issue refunds and reconcile payments.

Fyno is not a bank, payment institution or e-money institution, and we never hold, receive or transfer your money or your customers' money. Pay by bank payments are initiated by our regulated payment partner (currently GoCardless Ltd, authorised by the Financial Conduct Authority), and money is paid directly into your bank account.

To take payments through Fyno, you must:

  • open an account with our payment partner,
  • pass its business verification checks, and
  • accept its terms.

Those terms are a separate contract between you and the payment partner, and they govern the payment services. Fyno is not responsible for the payment partner's decisions, such as declining to verify you, holding a payment or closing your payment account. We may add or change payment partners and will give you reasonable notice if this affects you.

3. Who can use Fyno

You must:

  • be a business, or a sole trader acting for business purposes, based in the United Kingdom
  • be at least 18
  • give accurate, complete and up-to-date information, and keep it updated
  • use Fyno only for lawful business purposes and in line with our Acceptable use policy

Fyno is for business use only. You agree that you are not entering these terms as a consumer.

4. Your account

  • You are responsible for everything done through your account, including by team members you invite.
  • Keep login details secure and use multi-factor authentication where we require it.
  • Tell us immediately at support@fynopayments.co.uk if you suspect unauthorised access.
  • Give team members only the access they need. You are responsible for their actions.

5. Free trial and design partners

We may offer a free trial or a free design-partner period. We'll tell you when it ends. When it ends, your chosen paid plan starts unless you cancel first. We'll remind you before you are charged.

6. Fees and payment

  • Subscription: you pay the monthly (or annual) fee for your plan, shown on our pricing page or agreed with you in writing.
  • Per-payment fees: you pay our fee for each completed Pay by bank payment, as set out for your plan (a percentage of the payment, subject to any minimum and maximum (cap) shown).
  • Payment partner fees: our payment partner may charge you its own fees under its terms. Where it does, we'll show these clearly before you sign up.
  • Messaging: SMS and WhatsApp messages are included up to any fair-use limit for your plan. Beyond that, we may charge for message bundles, but we'll tell you before you incur any charge.
  • VAT: all prices exclude VAT, which will be added where it applies.
  • How we collect fees: we charge subscription fees in advance, and per-payment fees either as they arise (for example, deducted by our payment partner as an application fee) or monthly in arrears, by card or Direct Debit through our billing provider (Stripe).
  • Late payment: if a payment fails, we'll tell you and try again. If fees remain unpaid for 14 days after we have notified you, we may suspend your account until they are paid. We may also charge statutory interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
  • Price changes: we may change our prices with at least 30 days' notice. If you don't agree, you can cancel before the change takes effect.
  • Fees already paid are non-refundable, except where these terms or the law say otherwise.

7. Your responsibilities to your customers

You are responsible for your relationship with your customers, including:

  • the goods and services you sell, your prices and your own terms and conditions
  • complying with consumer protection law, including giving accurate information about how customers pay. Pay by bank payments are not covered by chargebacks or Section 75 credit-card protection, so you must not suggest otherwise, and you must explain any deposit protection you offer accurately
  • handling disputes, cancellations and refunds with your customers
  • having a lawful basis to contact customers by SMS, WhatsApp and email, and using Fyno messages only for payment-related communications about transactions your customers have entered into with you, not marketing
  • complying with data protection law as the controller of your customers' information. Our Data processing agreement forms part of these terms and governs how we process that information for you

8. Payments, refunds and large payments

  • A payment shows as "Paid" in Fyno only when our payment partner confirms it has completed. Until then, treat it as not received.
  • Customers' banks may apply limits, fraud checks or delays, especially to large or first-time payments. Fyno may offer options such as split payments or bank transfer details, but we don't guarantee any payment will be authorised by a bank or completed.
  • Refunds are made through our payment partner where it supports them, and may be subject to its fees and rules.
  • You must check that payments have arrived in your bank account before releasing high-value goods, such as vehicles.

9. Availability and changes to Fyno

We'll use reasonable skill and care to provide Fyno and keep it available, but it may sometimes be unavailable, for example during maintenance or if a bank, our payment partner or another provider has an outage. We'll try to give notice of planned maintenance. We may improve or change features. If a change significantly reduces what you've paid for, we'll tell you and you may cancel.

10. Integrations

If you connect third-party apps (for example, Xero), their terms apply to your use of them. You authorise us to exchange data with them as needed to provide the integration. We're not responsible for third-party apps.

11. Suspension and termination

  • You can cancel at any time in your account settings or by emailing us. Cancellation takes effect at the end of your current billing period. Annual plans are not refundable for unused months unless we agree otherwise.
  • We can end these terms with 30 days' notice for any reason.
  • We can suspend or close your account immediately if:
    • you seriously or repeatedly breach these terms or the Acceptable use policy,
    • we reasonably suspect fraud, scams, money laundering or other unlawful activity,
    • our payment partner or a regulator requires it, or
    • you don't pay fees after notice. Where the law allows, we'll explain why.
  • After closure, you can export your data for 30 days. We then delete or return it as set out in the Data processing agreement, except for records we must keep by law.

12. Intellectual property

We (and our licensors) own Fyno, including its software, design and content. While these terms are in force, we give you a non-exclusive, non-transferable right to use Fyno for your business. You own your data and content, such as your logo and customer records. You give us permission to use them only to provide Fyno to you. If you send us feedback, we may use it freely.

13. Confidentiality

Each of us will keep the other's confidential information secret and use it only for the purposes of these terms, except where disclosure is required by law or to professional advisers bound by confidentiality.

14. Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
  • We are not liable for:
    • loss of profits, revenue, business, goodwill or anticipated savings
    • indirect or consequential loss
    • losses caused by our payment partner, banks, messaging providers or other third parties outside our reasonable control
    • a payment being declined, delayed, held or reversed by a bank or our payment partner
    • your failure to check that funds have arrived before releasing goods or services
  • Our total liability to you in any 12-month period is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
  • You are responsible for, and will compensate us for, losses we suffer from claims by third parties (including your customers or regulators) arising from your breach of these terms, the Acceptable use policy or the law.

15. Events outside our control

We're not responsible for delays or failures caused by events outside our reasonable control, such as outages at banks, payment partners, hosting or messaging providers, internet failures, cyber attacks, strikes or natural disasters.

16. Changes to these terms

We may update these terms. For significant changes, we'll give you at least 30 days' notice by email or in the app. If you continue using Fyno after the change takes effect, you accept the new terms. If you don't agree, you can cancel before then.

17. General

  • These terms, together with the Acceptable use policy, Data processing agreement and Privacy policy, are the whole agreement between us about Fyno.
  • If any part is found unenforceable, the rest still applies.
  • If we don't enforce a right straight away, we can still enforce it later.
  • Nobody else has rights under these terms.
  • Notices to us must be sent to support@fynopayments.co.uk. Notices to you will be sent to the email address on your account.

18. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Before going to court, please contact us so we can try to resolve the matter informally.
